Terms and Conditions

1. This promotion, 'Dine Out From £10', entitles voucher holders to enjoy two food courses from £10 per person (unless stated otherwise) and may be redeemed at participating restaurants by diners aged 18 years or over.
2. Details of this promotion form part of the terms and conditions.
3. The promotion will be published inside the Telegraph from 1 - 6 November 2009 and at various times throughout the duration of the promotion, which expires on 30 April 2010 (unless stated under the individual listing). A personalised voucher may also be downloaded from this site after choosing the restaurant you wish to visit. The downloadable voucher is only valid when used in conjunction with either the full copy of The Daily or The Sunday Telegraph or the front page of the edition, to be purchased and dated the same day as the diner takes up the offer.
4. Only one voucher can be used per visit, per booking.
5. A minimum of one and up to a maximum of four people may dine together on one voucher. A group of four can comprise of a minimum of two adults and a maximum of two children. Children's menus are not covered by this offer and some restaurants may not allow under 18s to dine. Please check at the time of booking.
6. Some participating restaurants may advertise promotional menus, set menu choices or a limited range of dishes to which this promotion applies. The variety of dishes available does vary from restaurant to restaurant so prior clarification of the offering is advised. At Old English Inns, the �Two meals for £9.95� offer is an existing offer and is therefore not exclusive to Telegraph Readers.
   
   Restaurants reserve the right to change the offer advertised without prior notice. For the most up-to-date offer and availability applicable to each restaurant, please see the listings and details advertised at this website.
7. Some participating restaurants advertise Dine Out From £10 and/or Dine Out From £15 or both or Two Meals For £9.95, and some restaurants may offer three courses under this promotion. Facilities and menus vary from restaurant to restaurant. Please speak to the restaurant to confirm at the time of booking.
8. Participating restaurants in the Republic of Ireland may offer Dine out from 10 Euros and/or Dine from 15 Euros for either two or three courses under this promotion.
9. This offer applies to advance reservations only. Participants must state clearly that they are booking under the 'Telegraph's Dine Out From £10� promotion and where appropriate, which menu they wish to book under at the time of booking. This promotion is offered subject to availability at the restaurant's discretion. Each restaurant has a limited number of covers available for this promotion and early booking is advised.
10. There is no restriction on the number of vouchers that can be redeemed by readers. Offer applies to new and direct bookings only. Offer is not valid against any existing booking.
11. The discount cannot be used in conjunction with any other vouchers, discounts or offers. Only published original vouchers from The Daily or The Sunday Telegraph, or the downloaded personalised vouchers from this site will be accepted.
12. Upon arrival at your chosen restaurant, presentation of your voucher will be required. If this is an online voucher, a copy of that day's Telegraph will also need to be shown. The offer may not be honoured if you do not declare that you hold a Telegraph 'Telegraph Dine Out From £10' voucher at the time of booking.
13. Please note that a credit card may be required to secure your booking.
14. Some restaurants operate a cancellation policy. It is advisable to confirm the details when booking.
15. The normal terms and conditions of each restaurant also apply. It is the responsibility of the diner to make themselves aware of these and to comply with these terms and conditions.
16. Counterfeit, defaced, photocopied or otherwise reproduced vouchers will not be accepted. Neither the Promoter nor the restaurants can accept any responsibility for lost, stolen or damaged vouchers.
17. Unless where otherwise stated, bookings must be made and completed by 30 April 2010.
18. This offer may exclude local special events held in individual restaurants, bank holidays (including Easter), Christmas and New Year from 25 December 2009 to 3 January 2010, Valentine's Day, Mothering Sunday and Father's Day. Some participating restaurants may also exclude certain days, times, evenings or lunches and these will be shown in the listing under 'Availability'. Please ensure you consult this prior to any bookings or visits.
19. Any additional courses that are ordered, over and above the promotional 'Dine Out From £10' offer, will be charged at the restaurants' standard menu prices. The offer includes VAT and cover charge(s), but does not include extra courses, drinks, coffee or service, (unless otherwise stated). Some restaurants may add an additional service charge to the final bill.
20. The Promoter reserves the right to vary or amend this promotion and the reader agrees that no liability shall attach to the Promoter as a result thereof. The Promoter is responsible for the first part of the promotion, that is, the provision of vouchers. All other facilities connected with this promotion are contributed by, and are the responsibility of the individual restaurant(s).
21. All details and descriptions have been supplied by the participating restaurants and are believed to be correct at the time of going to print. Neither the Promoter, nor its agent, can accept any responsibility for any discrepancies, inaccuracies or misconceptions given or construed.
22. The Promoter and Agent cannot accept any responsibility for your use or enjoyment, or the quality, of a restaurant, the suitability of the restaurant concerned or any loss, damage or injury you suffer at any participating restaurant. All such issues are the responsibility of the restaurant concerned. Any issue or dispute relating to the dining offer (other than the validity of the voucher) should be referred to and settled direct with the restaurant concerned. The Agent and Promoter are happy to investigate any unresolved problems. However, it cannot be held responsible for the actions of the restaurant. The offer will cease to be available if any individual restaurant changes ownership or goes into receivership after the publication of the list unless decided otherwise at the discretion of new management of that restaurant.

(6) computer viruses, system failures or malfunctions which may occur in connection with your use of the Site; or

Notwithstanding any provision of these Terms, Fresh Travel Ltd and TMG does not exclude or limit its liability for:

(1) death or personal injury caused by its negligence or that of any of its officers, employees or agents; or

(2) fraudulent misrepresentation; or

(3) any liability which it is not lawful to exclude either now or in the future.

14.Indemnity

You will indemnify and will keep indemnified Fresh Travel Ltd and TMG and its data providers and affiliates on demand against all claims, costs, proceedings, demands, losses, damages, expenses (including legal expenses) or liability whatsoever arising directly or indirectly as a result of:

(1) any breach of these Terms by you; or

(2) your fault, negligence or breach of statutory duty; or

(3) your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure (whether owned by, leased or licensed to us) or that of any of our Suppliers.

15. General

Any contractual or legal relationship between you and Fresh Travel Ltd and TMG will be concluded in English.

All notices shall be given by e-mail to us at info@freshrewards.co.uk or telegraphenquiries@telegraph.co.uk or, to you at either the e-mail or postal address you provide during the registration process (if any). Notice will be deemed received 24 hours after e-mail is sent or 3 days after the date of posting.

These Terms (together with any variations to them pursuant to section 2) form the entire agreement between the parties concerning your access to, browsing and/or use of the Site and supersede all prior agreements, arrangements, understandings and representations made between us (whether written or oral) concerning the Site.

The licence granted in section 4.2 above is personal to you and may not be assigned, transferred or sub-licensed (in whole or in part) without our prior written consent.

Nothing in these Terms is intended to or shall operate to create a partnership or joint venture of any kind between us or to authorise either of us to act as agent for the other, and neither of us shall have authority to act in the name or on behalf of or otherwise to bind the other in any way (including but not limited to the making of any representation or warranty, the assumption of any obligation or liability and the exercise of any right or power).

If the whole or any part of any provision of these Terms is or becomes invalid, void or unenforceable for any reason the same shall to the extent required be severed from these Terms and rendered ineffective so far as is possible without modifying the remaining provisions of these Terms and shall in no way affect the validity or enforceability of any other provisions.

No waiver of any breach of these Terms shall constitute a waiver of any other prior or subsequent breach and Fresh Travel Ltd and TMG shall not be affected by any delay, failure or omission to enforce or express forbearance granted in respect of any of your obligations.

The rights and remedies of Fresh Travel Ltd and TMG under these Terms are independent, cumulative and without prejudice to its rights under the law.

These Terms are not intended to create and shall not create any rights, entitlements, claims or benefits enforceable by any third party by virtue of the Contracts (Rights of Third Parties) Act 1999.

These Terms and/or your use of the Site shall be governed by and construed in accordance with English law and the English Courts shall have exclusive jurisdiction over any dispute which may arise.
